The Georgia Court of Appeals is scheduled to hear arguments on December 5 from former President Donald Trump’s legal team, seeking the removal of Fulton County District Attorney Fani Willis from the election-related case against him. This follows the court’s decision in May to review a ruling by Fulton County Superior Court Judge Scott McAfee, which permitted Willis to remain on the case.
Trump’s team has pushed for Willis’s disqualification due to her personal relationship with special prosecutor Nathan Wade. In March, Judge McAfee ruled that either Wade or Willis had to leave the case. Wade subsequently withdrew from the case following the ruling. The Georgia Appeals Court has since agreed to pause proceedings while it reviews this ruling, with a deadline for a decision set for March 2025, as reported by CBS News.
Trump is facing 10 charges in Georgia related to his actions after the 2020 election. However, public focus has shifted from the case itself to the alleged inappropriate relationship between Willis and Wade, and claims of financial benefits Willis supposedly received from this relationship.
Michael Roman, a co-defendant, stated that Wade and Willis’s relationship began before Wade was hired for the Trump case. Trump’s team has joined Roman’s motion to dismiss the charges, arguing that the prosecution is invalid.
Additionally, the recent Supreme Court ruling on presidential immunity may influence the prosecution. It is expected that Judge McAfee will conduct a review to determine if the charges in this case meet the criteria established by the Supreme Court ruling.
